1. Scope
These Terms and Conditions govern the use of this website and the purchase of products offered through eWatcheshouse.
By placing an order through this website, you confirm that you have read and accepted these Terms and Conditions.
These Terms apply to sales made through the online store unless a separate written agreement has been made.
2. Products and product information
We sell modern watches, vintage watches, pocket watches, clocks, accessories, and selected related products. Product availability is subject to stock and may change without notice.
We aim to ensure that product descriptions, specifications, measurements, photographs, and pricing are accurate. Minor variations may occur, including differences in colour tone, texture, packaging, or visual appearance due to lighting, screens, age, or manufacturing differences.
Vintage, pre-owned, and old new stock items may show signs of age, storage, wear, patina, prior servicing, replacement parts, or other condition characteristics that are normal for such goods or specifically disclosed in the listing.
If a disclosed characteristic, visible wear, or specifically stated defect is shown in the listing or product photographs before purchase, it is considered part of the agreed product condition.
3. Prices
All prices shown on the website are stated in EUR unless otherwise indicated.
Prices include VAT where applicable, unless expressly stated otherwise.
Shipping fees, payment fees if any, import duties, customs charges, and other delivery-related costs are not included in the product price unless expressly stated at checkout.
For deliveries outside the European Union, the customer is responsible for any import duties, customs clearance charges, local taxes, or similar charges imposed in the destination country, unless stated otherwise.
4. Ordering process and contract formation
Orders may be placed through the website by adding products to the shopping cart and completing the checkout process.
After an order is placed, the customer will receive an order confirmation email acknowledging receipt of the order. This confirmation does not necessarily mean that the order has been accepted.
A sales contract is formed when the order is accepted and the product is dispatched, or when we otherwise confirm acceptance in writing.
We reserve the right to refuse, cancel, or limit an order in cases including product unavailability, obvious pricing or description errors, suspected fraud, payment issues, legal restrictions, or shipping limitations.
5. Payment
Payment methods available for an order are shown during checkout. Orders are normally processed only after successful payment authorisation, confirmation, or acceptance of the selected payment method under the applicable checkout conditions.
We may use third-party payment service providers. In such cases, payment data is processed by the relevant provider under its own terms and privacy standards.
If a payment is declined, reversed, or flagged for security reasons, the order may be delayed, suspended, or cancelled.
6. Delivery
We ship to selected countries worldwide, subject to courier availability, legal restrictions, and destination-specific limitations.
Estimated dispatch and delivery times are shown on the website, in the Delivery page, or in the order confirmation where available. These timeframes are estimates and not guarantees unless expressly stated otherwise.
Delivery is considered completed when the goods are delivered to the address provided by the customer or to the customer’s designated recipient.
Risk of loss or damage passes to the consumer when the consumer, or a third party indicated by the consumer other than the carrier, takes physical possession of the goods.
The customer is responsible for providing accurate shipping details. We are not responsible for delays or additional costs caused by incorrect addresses, customs processing, failed delivery attempts, or destination-country restrictions.

7. Right of withdrawal for consumers
If you are a consumer purchasing at a distance, you generally have the right to withdraw from the purchase within 14 days without giving any reason.
The withdrawal period expires 14 days after the day on which you, or a third party indicated by you other than the carrier, acquire physical possession of the goods.
To exercise the right of withdrawal, you must notify us by a clear written statement sent by email or post before the withdrawal period expires. You may use the model withdrawal form included below, but it is not mandatory.
You must send back the goods without undue delay and no later than 14 days after informing us of your decision to withdraw. The deadline is met if you send the goods before the 14-day period has expired.
Unless we expressly agree otherwise, the direct cost of returning the goods is borne by the customer.
You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
The right of withdrawal may not apply to goods excluded by applicable law, including clearly personalised or custom-made goods, or other exempt goods where such exemption lawfully applies.
8. Refunds
Refunds for valid withdrawals are normally made using the same payment method used for the original transaction, unless expressly agreed otherwise.
We may withhold reimbursement until we have received the returned goods or until you have supplied evidence of having sent them back, whichever occurs first.
Original standard delivery charges will be reimbursed to the extent required by applicable consumer law. Additional costs arising from a delivery method chosen by the customer that is more expensive than the standard delivery method offered by us do not have to be reimbursed.

9. Non-conformity, legal remedies, and warranty
Consumers have statutory rights if goods do not conform to the contract. These rights apply in addition to any commercial warranty that may be offered.
If a product is non-conforming, the consumer may be entitled, depending on the circumstances and applicable law, to repair, replacement, price reduction, or termination of the contract.
If you believe a product is non-conforming, please contact us as soon as possible and provide your order details, a description of the issue, and supporting photographs where relevant.
For consumers, statutory claims for non-conformity are governed by applicable law. Any commercial warranty offered for a specific product will be described in the product listing or accompanying documentation and does not limit mandatory legal rights.
Normal wear and tear, accidental damage, misuse, improper handling, unauthorised repair, water damage outside stated resistance limits, battery depletion, strap wear, impact damage, magnetic exposure, and damage caused by failure to follow care instructions are not treated as product non-conformity unless required by law.
10. Special terms for vintage, used, and old new stock items
Vintage, pre-owned, and old new stock items differ from newly manufactured goods. Such items may have signs of age, patina, cosmetic wear, historical servicing, part replacement, storage marks, or performance variation consistent with their age and category.
Water resistance, shock resistance, timing accuracy, and long-term service intervals of vintage or older watches should not be assumed to match modern factory standards unless expressly stated in the product description.
Any condition note, disclosed defect, visible imperfection, or age-related feature specifically stated in the listing or visible in the product photos forms part of the agreed description of the goods.
Nothing in this section limits mandatory consumer rights in relation to hidden non-conformity that was not disclosed before sale.
11. Repairs, batteries, straps, and related services
If we provide repair, battery replacement, strap fitting, or similar services, the exact scope of work shall be limited to the service agreed with the customer.
Estimates for service timing are indicative unless expressly confirmed as binding.
Where a customer supplies their own component, strap, bracelet, or watch for service, we are not responsible for defects inherent in the customer-supplied item.
12. Intellectual property and website use
All content on this website, including text, photographs, graphics, product descriptions, logos, and layout, is protected by applicable intellectual property law and may not be copied, reproduced, republished, or used commercially without prior written consent, except as permitted by law.
You may use this website only for lawful browsing, inquiry, and purchasing purposes.
13. Limitation of liability
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including mandatory consumer protections.
To the maximum extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss caused by delay outside our reasonable control, or loss arising from misuse of the product.
We are not responsible for temporary website interruption, technical errors, or third-party service failures outside our reasonable control, although we aim to correct issues as quickly as practicable.
14. Privacy and personal data
Personal data submitted through the website or during the ordering process is processed in accordance with our Privacy Policy.

15. Complaints and dispute resolution

16. Governing law
These Terms are governed by the laws of the Republic of Latvia, unless mandatory consumer protection rules of the customer’s country of habitual residence apply and cannot be excluded by agreement.
Any dispute shall be handled by the competent authority or court in accordance with applicable law.
